Claim for Hire Charges Tainted by Illegality:Judge Dean QC in Central London County Court rejected a claim for damages in respect of vehicle hire charges on the basis that it was tainted by illegality. The Judge found that the Claimant had deliberately set out to mislead the Court over the fact that he had no insurance at the time of the index accident; the evidence supported the inference that he would have continued to drive without insurance in the absence of some intervening event. The principle of ex turpi causa was not merely a matter of discretion but was fact specific; the present case was clearly one that fell within the ambit of that principle.
