Ulucesme v Goel (QBD) - 10/06/14

Description

The claimant mother gave birth to a baby with Down's Syndrome and brought a claim against the defendant general practitioner (GP). The claimant mother had medical treatment in Turkey for kidney trouble and during that time she had a triple test which showed positive and revealed that her baby would probably have Down's Syndrome. The Turkish triple test was contrary to the English tests which were negative for Down's Syndrome. However, she failed to disclose the results of the Turkish triple test to her GP. It was held that the defendant was not at fault and he was not liable in negligence
