Description

Primary Factual Evidence More Important Than Accident Reconstruction Evidence:Coulson J. held that although cases such as the instant case often featured the evidence of accident reconstruction experts, and there was no doubt that their expertise could sometimes be of considerable assistance, it was the primary factual evidence that was of the greatest importance. Re-iterating the Court of Appeal's guidance in Liddell v. Middleton (1996), he made clear that the function of the expert was limited to furnishing the judge with the necessary scientific criteria and assistance based upon his special skill and experience not possessed by laymen.
