Description

The pursuer was working offshore and sustained his injuries as a result of the ladder which he used to get down from his bunk not having been properly secured. The pursuers case was pled under regulations 4 5 and 20 of the Provision and Use of Work Equipment Regulations 1998 (the Work Equipment Regulations 1998). The sheriff assoilzied the defenders on the basis that the ladder was not work equipment that pursuer was not at work when the accident took place and that the defenders had not failed in their duties to ensure that the ladders were suitable etc. The appellant submits that the sheriff misconstrued at work and work equipment.
