Morag Jean Holtes v. Aberdeenshire Council [2006] CSOH 134

Description

In this action the pursuer sued Aberdeenshire Council in respect of injuries she received whilst at work on 1 May 2003. The pursuer was employed as a project officer within the Criminal Justice Team of the Social Work Department of Aberdeenshire Council and was responsible for administering the community service scheme within Aberdeenshire Council. On 1 May 2003 the pursuer was coming down a set of stairs at the defenders' offices when she tripped and fell. The action went to proof on liability only, quantum having been agreed. On behalf of the pursuer it was argued that the accident occurred as a consequence of the defenders' negligence at common law and in breach of their duties in terms of Regulations 5, 12 and 13 of the Workplace (Health, Safety and Welfare) Regulations 1992.
