Recoverability of cost of local authority case from tortfeasor: A local authority that providing residential care to a person injured as a result of the negligence of an NHS trust could not recover the cost of providing such care directly from the trust in a claim for negligence, since the trust did not owe a duty of care to the local authority. The court noted that the difficulty in this case, accidental or not, was a matter for Parliament to resolve, and not the courts.
