Hickman v London Central Bus Company Ltd [2013] EWHC 1703 (QB) - 21/06/13

Description

This was an assessment of quantum in a case where a bus had run over a pedestrian causing him serious injury. The court held that both parties should have been keeping a better lookout. Had the Defendant's driver been keeping a better lookout the accident might have been avoided. There was an ongoing duty to keep a proper lookout. On the facts, the Defendant was 60% to blame for the accident and the Claimant 40%. Liability was apportioned accordingly.
