Claim Failed Against Asbestos Removal Contractor:Foskett J dismissed a claim in negligence against an asbestos removal contractor on the grounds that it was known to the Claimant that, in respect of both the original removal method and revised sealed method employed, not all of the asbestos would be removed and that some of the asbestos would simply be sealed. In all of the circumstances, the contractor would not have given a guarantee that all traces of asbestos would be removed and furthermore, the remedial works had been carried out competently.
