Description

This case provided one of the first decisions interpreting the Workplace (Health, Safety & Welfare) Regulations 1992. It held that the individual regulations are not mutually exclusive and should be looked at in conjunction with one another. In doing so the court adopted a purposeful interpretation of the regulations, in accordance with the spirit of the EC Workplace Directive (89/654/EEC).
