This was a defence appeal against the competency of sentence. The accused originally pled guilty to a contravention of section 4(3)(b) of the Misuse of Drugs Act 1971 on 26 October 2010 at Glasgow Sheriff Court. The procurator fiscal depute gave a narration to the court but that narration did not accord with the evidence or the narration previously agreed between the defence and the Crown. Appeal Court: Appeal of sentence imposed following guilty plea to murder. Appellant pled guilty to murder on the second day of the trial following two failed lesser pleas which were refused. The guilty plea was made after viewing of a DVD of an interview with a Crown witness which had not been available at the beginning of the trial.
