Despite the inherent dangers of building sites, the court looked at whether the existing regulations had been complied with and existing good practice followed, and whether the likelihood of Mr Petersen's death occurring could have been reduced.

This was an FAI into the death of Mr Cadger which was as a result of a road traffic collision when the small van he was driving was involved in a head on collision with a large goods vehicle. The accident occurred when Mr Cadger pulled out from his carriageway to overtake and collided head on with an oncoming vehicle. He sustained massive injuries and died instantaneously. The court considered the accident circumstances.

This was an FAI into the death of Mr Campbell who died following an accident in the course of his employment with ASCO, when he fell from the steps of a forklift truck landing on his coccyx, falling backwards and striking the back of his head on the ground.
